4.1By completing registration, you agree to these terms and enter into a contract with us when your registration is accepted on our Service. (This is different from the Seller Services Contract between Seller and Buyer – see below).
4.2We may refuse any registration where we have a lawful reason to do so.
4.3If you use any part of our Service that does not require registration, these terms still apply to you so far as relevant.
5. Your right to use our Service
THIS SECTION SETS OUT CERTAIN LIMITS ON YOUR RIGHT TO USE OUR SERVICE
5.1We give you a limited, personal and non-transferable right to use our Service on any applicable device owned or controlled by you subject to these terms.
5.2If you register as a Seller, you confirm that you are using our Service for purposes relating to your trade, business, craft or profession and not as a Consumer.
5.3You must comply with any applicable third party terms when using our Service.
5.4You must not use or register for our Service if:
- you are under 18; or
- using or accessing any relevant part of our Service is unlawful in the country from which you access it.
5.5You must complete any age or identity checks that we reasonably require and provide accurate information for those checks. We may suspend, restrict or close your account if you do not satisfactorily complete them.
6. Standard of Service
THIS SECTION SETS OUT THE STANDARD OF SERVICE THAT WE PROMISE YOU WHEN PROVIDING OUR SERVICE
6.1We will provide our Service with reasonable skill and care.
7. Changing these terms
THIS SECTION SETS OUT WHAT HAPPENS IF WE CHANGE THE TERMS AND WHAT TO DO IF YOU DISAGREE
7.1We may update these terms from time to time, for example to reflect changes in the Service, the law, or our business operations. We will give you reasonable notice of any important changes and tell you when they take effect. Where you are a Seller, we will give you any minimum notice required by law.
7.2If you do not agree to the changes, you can end your contract with us before they take effect by emailing us (to the address below). Existing paid arrangements between Buyers and Sellers will continue until their current paid period or scheduled date unless we reasonably cancel or suspend them, but they will not renew and you cannot enter into new arrangements after your contract ends. If you continue to use our Service after the changes take effect, the updated terms will apply.
8. Behaviour when using our Service
THIS SECTION SETS OUT THE BEHAVIOUR AND OTHER REQUIREMENTS TO USE OUR SERVICE
8.1You agree not to do any of the following in connection with our Service:
- break the law or infringe anyone else's rights;
- upload, send, store, display or link to Content that breaches these terms or our Rules relating to Prohibited Images & Content;
- harass, abuse, threaten or discriminate against anyone;
- deceive, mislead or impersonate anyone;
- interfere with, damage or disrupt our Service, including by introducing viruses, spam or other harmful material;
- gain or attempt to gain unauthorised access to our systems, data, accounts or security features;
- use our Service to compete with us or infringe our rights; or
- attempt, encourage or help anyone to do any of the above.
8.2You must comply with our reasonable rules and requirements relating to our Service and provide reasonable cooperation where we ask for it.
8.3You must ensure that information you provide to us is accurate and not misleading and promptly tell us about any important changes.
8.4If we remove or restrict your Content or suspend or ban you in breach of these terms, you may have a right to bring a claim against us for breach of contract.
9. Seller Services Contract
THIS SECTION EXPLAINS THE CONTRACT BETWEEN BUYERS AND SELLERS AND OUR ROLE IN FACILITATING IT
Forming a Seller Services Contract
9.1Our Service is a platform where independent Sellers can offer Seller Services to Buyers under the Seller Services Contract in this section of the terms. Before contracting, you must check that the Seller Services Contract is suitable for you. The Buyer and Seller can agree additional terms for Seller Services provided they are consistent with these terms. You agree to comply with every Seller Services Contract you enter into.
9.2A separate Seller Services Contract is formed whenever a Buyer buys a subscription, digital content, access to a live session, a one-to-one session, custom content or goods from a Seller. The contract becomes binding when a confirmation email is sent to the Buyer.
9.3We are allowed to end or suspend any Seller Services Contract if we think it is necessary because of breach, fraud, safety, legal compliance or another serious issue.
9.4We are not party to the Seller Services Contract and do not supply Seller Services. Sellers decide what to offer and set their own prices.
Sale of physical goods
9.5If you buy or sell any physical goods, the Seller Services Contract includes the Terms for Sale of Goods by Sellers which form part of the contract between the Buyer and Seller.
9.6Where our Service provides a shipping-label or similar delivery facility, the Seller must use it as instructed. If so, the delivery charge will be automatically set and paid to the courier. Otherwise, the Seller is responsible for arranging delivery by the method and at the delivery price shown to the Buyer before purchase.
Dealings generally
9.7You must deal with other Users reasonably and courteously and respond promptly to relevant communications.
9.8Seller Services and related communications must take place through our Service except where we specifically allow otherwise.
9.9Sellers must:
- provide Seller Services with reasonable skill and care where applicable;
- comply with applicable laws and regulations; and
- not infringe anyone else's rights.
Coins
9.10Buyers pay for Seller Services using Coins purchased from us through the Service. The price for buying Coins, including our fee and any applicable taxes, will be shown before you buy them.
9.11One Coin has a value/currency explained on the Service when you buy. If you buy Coins in another currency, the amount you pay will depend on the applicable exchange rate shown when you make the purchase.
9.12Coins can only be used on our Service. They cannot be transferred to another User or exchanged by a Buyer for cash except where required by law.
9.13When a Buyer purchases Seller Services, the required Coins are deducted from the Buyer's account and the corresponding amount is credited to the Seller subject to any applicable fees under these terms and the payment-release provisions below.
9.14IMPORTANT: Coins will be deleted when a Buyer or Seller account is closed except insofar as we expressly agree to retention of Coins for a specified period.
Subscriptions to Sellers
9.15A Seller may offer a monthly subscription at the price shown on their profile. Unless cancelled, the subscription automatically renews each month and the required Coins are automatically deducted from the Buyer's account. We will send any reminder notices required by law.
9.16A Buyer can cancel a Seller subscription at any time as explained on our Service. Cancellation takes effect at the end of the current paid period, and the Buyer retains access until then. There is no refund for the remaining part of that period unless required by law.
9.17A Seller subscription gives the Buyer access during the subscription period to the digital photos and pre-recorded videos that the Seller makes available to subscribers. It does not include live sessions, one-to-one sessions, custom content, goods or anything else separately charged for.
9.18A Seller cannot increase the price of an existing automatically renewing subscription.
Live sessions (including pre-scheduled and one-to-one)
9.19Any free preview of a pre-scheduled live session does not entitle the Buyer to continue viewing the session without payment.
9.20Neither Buyers nor Sellers may record, screenshot, copy or distribute any live session by any means.
9.21During a pre-scheduled live session, a Buyer may voluntarily send a Seller a Tip in Coins using the “Gift” facility on our Service. Unless required by law, Tips cannot be cancelled or refunded once sent. We deduct our applicable fee before crediting the balance to the Seller.
9.22Unless we or the Seller cancel the session, payment for a pre-scheduled live session is non-refundable if the Buyer does not attend or stops viewing it.
9.23Sellers must provide a full refund to Buyers if they cancel a live session (unless the parties agree to reschedule a one-to-one session).
9.24Sellers are responsible for making any Buyer cancellation and rescheduling rules for one-to-one sessions clear to Buyers before they order.
9.25Cancellation or rescheduling must be carried out through our Service and takes effect when recorded by our Service.
Custom content
9.26If a Buyer and Seller agree that the Seller will create custom digital content, they must agree through our Service what is to be supplied, the price and the delivery period before the Buyer pays.
9.27The Seller must supply the agreed custom content within the agreed delivery period, which must not be longer than seven days after payment.
9.28Seller must provide a full refund if they fail to supply the agreed custom content within that period.
Consumer cancellation rights
9.29If you are a Consumer, cancellation (“cooling off”) rights might apply. See the Annex at the end of this document for more information.
Confirmation, disputes and release of payment
9.30Payments for Seller Services (excluding Tips) are initially held pending completion of the transaction. The Seller must use our Service to confirm when the relevant Seller Services have been supplied or, for goods, delivered.
9.31We will notify the Buyer, who then has 14 days to confirm satisfactory completion or raise a dispute through our Service.
9.32If the Buyer confirms satisfactory completion, we may release the relevant amount to the Seller. If the Buyer does not respond within 14 days, we may either release the amount to the Seller or review the transaction ourselves.
9.33If the Buyer raises a dispute, or we decide to review a transaction, we may decide how the relevant amount should be allocated. We may release it to the Seller, refund it to the Buyer or divide it between them as we consider reasonable.
9.34The Buyer and Seller must provide any information or evidence we reasonably request in connection with a dispute. Our decision concerns only the allocation of the amount held by us and does not determine any wider legal dispute between the Buyer and Seller.
9.35If you have any other complaint or dispute involving another User, please report it using the methods provided on our Service. We may assist but are not obliged to resolve disputes other than as expressly stated above.
Payment to Sellers
9.36Amounts credited to a Seller are held in the Seller's wallet until available for withdrawal in accordance with these terms.
9.37Subject to the dispute and refund provisions above, a Seller may request withdrawal of available funds to their nominated bank account using our payment provider. We may impose a minimum withdrawal amount and may require additional approval for withdrawals above limits that we set.
9.38We may withhold or suspend a withdrawal where reasonably necessary to deal with a dispute, refund, chargeback, fraud, legal or safety issue or breach of these terms.
9.39If a payment relating to Seller Services is charged back or reversed after funds have been released to the Seller, we may deduct the amount from any money held for the Seller or require the Seller to repay us.
9.40Sellers are responsible for their own taxes arising from Seller Services. You should take your own tax advice.
Not circumventing our platform
9.41You must not use our Service to arrange Seller Services with another User outside our Service or make or receive payment for Seller Services outside our Service.
For Sellers only
9.42You must not offer or sell anything prohibited by any rules shown on our Service, or anything that is unlawful to offer or sell.
9.43You must tell us promptly about anything that could reasonably affect our decision to allow you to remain a Seller, including any relevant criminal conviction.
9.44You accept that we do not guarantee that use of our Service will generate any particular level of revenues or suitable enquiries.
10. Paying us
THIS SECTION COVERS PAYMENTS YOU MAKE TO US, INCLUDING SELLER SUBSCRIPTIONS AND THE COST OF BUYING COINS
10.1Some parts of our Service are chargeable. The applicable prices and payment methods are shown on our Service.
Seller fees
10.2If you register as a Seller, or as both a Buyer and Seller, you must pay the monthly subscription fee shown on our Service.
10.3Your Seller subscription will continue to renew automatically each month unless you cancel it as explained on our Service. We will send any reminder notices required by law.
10.4You can cancel your Seller subscription at any time. Cancellation takes effect at the end of your current paid period, unless we allow or agree to earlier cancellation. You will not be entitled to a refund for the remaining part of that period unless required by law.
10.5We deduct our applicable percentage fee from the Coins paid by Buyers for pre-scheduled live sessions and Tips before crediting the balance to the Seller.
10.6Unless otherwise stated, our fees for Sellers exclude any applicable VAT which is payable in addition.
Buying Coins
10.7Buyers can purchase Coins from us at the price shown before purchase. The amount you pay may vary depending on the currency used and applicable exchange rates.
10.8The price shown when you buy Coins includes our fee and any applicable taxes.
10.9If you are a Consumer, cancellation (“cooling off”) rights might apply. See the Annex at the end of this document for more information.
General
10.10You authorise us and our payment provider to charge your chosen payment method whenever payment is due under this agreement. You are responsible for keeping your payment details up to date.
10.11If a payment to us is unpaid, reversed or charged back, we may suspend or restrict the relevant part of our Service until the amount due has been paid.
10.12You must contact us promptly if you believe that any payment charged by us is incorrect.
11. Your Content
THIS SECTION COVERS YOUR RESPONSIBILITY FOR CONTENT YOU PROVIDE AND OUR RIGHTS TO MODERATE OR REMOVE IT
11.1You are responsible for your Content.
11.2You must have all rights, licences and consents needed for us to use your Content as contemplated by our Service and these terms.
11.3Any review you post must reflect your honest and genuine opinion.
11.4Subject to applicable law and any right of appeal, we may reject, restrict, suspend, edit or remove Content if:
- it breaches these terms or our rules;
- we reasonably consider this necessary to protect Users, us or anyone else;
- it creates a legal, regulatory, safety, fraud or platform-compliance risk;
- we are required or permitted to do so by law or by a competent authority; or
- it does not meet our reasonable quality or technical requirements.
11.5Where legally permitted, we may disclose Content or information about related behaviour to the police, regulators, other appropriate authorities, service providers or a complainant where reasonably necessary to investigate or deal with suspected unlawful or harmful activity or to protect legal rights or safety.
11.6We may review or moderate Content before or after it is made available on our Service, but we do not promise to review all Content.
11.7We are not responsible for misuse of your Content by other Users or third parties. You should take appropriate care when deciding what Content to make available.
11.8You are responsible for keeping your own copies of Content you wish to retain. We are not responsible for loss that could reasonably have been avoided by you keeping a copy.
Seller listings
11.9We may edit the presentation or layout of your profile or listing to help it comply with these terms or our rules or to maintain the appearance and operation of our Service. You remain responsible for your Content even if we make such changes.
11.10We rank Seller listings by most recent posts or as otherwise explained on our Service. Rankings may be influenced by payment if we offer listings with increased prominence.
12. Collaborative Seller Content
THIS SECTION CONTAINS IMPORTANT REQUIREMENTS WHEN SELLER CONTENT FEATURES OTHER PEOPLE
12.1If your Content includes any other real person, whether or not their face is shown, they must be an individual aged 18 or over whose proof of identity, age and written informed consent to the creation, upload, distribution and sale of the Content you have obtained.
12.2You are responsible for keeping these records securely and providing them to us promptly on request.
12.3You are responsible for obtaining all licences, permissions, releases and consents necessary for the use of such collaborative Content.
13. Dealing with other Users/Illegal and harmful Content
THIS SECTION CONTAINS IMPORTANT WARNINGS ABOUT YOUR DEALINGS WITH OTHER USERS AND WHAT TO DO IF YOU ENCOUNTER MISBEHAVIOUR OR ILLEGAL/HARMFUL CONTENT
General
13.1We do not endorse or recommend Users or their Content. Subject to our legal obligations, you deal with other Users at your own risk and we are not responsible for their Content or conduct. You should make your own checks before relying on information supplied by another User.
13.2We cannot control what happens during one-to-one sessions. You participate at your own risk and should take reasonable steps to protect your safety and security and follow any safety guidance on our Service.
13.3You must not arrange to communicate or meet with other Users outside our Service unless we expressly allow this.
13.4If you encounter illegal, harmful or inappropriate Content or behaviour, or have concerns about your safety, you should stop the relevant interaction and report the matter using the reporting tools on our Service. You should also use any available blocking tools and contact the police or other appropriate authorities where necessary.
Our approach to safety and illegal/harmful Content
13.5Here are some of the steps we’re taking (or intend to take as and when necessary):
- default to maximum privacy settings;
- automated detection/filtering/blocking of inappropriate Content;
- moderation of Content in some circumstances;
- prominent and easy-to-use complaint/report buttons and blocking mechanisms;
- appropriate numbers and training of staff;
- procedures for categorising/prioritising/ tracking of User complaints/reports;
- reviewing complaint/report-handling performance; and
- carrying out appropriate risk assessments and regularly reviewing them.
14. Other websites and services
IN SHORT: WE AREN’T RESPONSIBLE FOR OTHER WEBSITES ETC
14.1Our Service may contain links to websites, advertising or services provided by other people. We do not control or endorse them and are not responsible for them.
15. If you create an account on our Service
IN SHORT: YOU ARE RESPONSIBLE FOR YOUR ACCOUNT AND MUST KEEP IT CONFIDENTIAL
15.1Unless our Service specifically says otherwise, your account is personal to you and must not be transferred or shared with anyone else.

15.3You are responsible for activity carried out through your account unless caused by our fault.

16.1We may provide support through the contact methods shown on our Service. Unless we say otherwise, we do not guarantee any particular response time or outcome.
16.2We are not obliged to provide support while you are in material breach of these terms.
17. Ending or suspending this contract
THIS SECTION TELLS YOU WHEN THIS CONTRACT CAN END OR BE SUSPENDED AND, IF SO, WHAT HAPPENS
17.1You can end your platform contract with us at any time as explained on our Service. Ending your platform contract does not itself cancel any separate Seller subscription or affect any rights or obligations that have already arisen.
17.2Subject to any applicable right of appeal if applicable, we may suspend, restrict or end your access to our Service if:
- you breach these terms or our rules;
- you fail to make a payment due to us or a payment is reversed or charged back;
- you act inappropriately towards us or others;
- you create legal, regulatory, fraud, abuse or safety risks;
- we are required to do so by law or by a competent authority; or
- we discontinue the Service.
17.3If you are a Seller and we end your contract, we will give you at least 30 days' notice unless we are entitled or required to end it sooner, for example because of a serious or repeated breach, legal requirement or safety risk.
17.4If this contract ends:
- existing Buyer-Seller transactions may continue to completion unless we cancel or suspend them in accordance with these terms;
- subject to the above, you must stop using our Service;
- no new Seller Services Contracts may be entered into after termination;
- we may retain or delete Content and account information subject to our legal obligations and Privacy Policy;
- we are entitled to delete Coins in Buyer or Seller accounts but if we agree to retention of Coins thereafter this will be for whichever period we specify and subject to these terms, including any dispute, refund, chargeback or withholding rights; and
- existing rights, and continuing terms, will still apply.
18. If our Service doesn’t work properly
IN SHORT: WE DON’T PROMISE THAT OUR SERVICE WILL BE ERROR-FREE
18.1We do not guarantee that our Service will always be uninterrupted or error-free.
18.2We may suspend the Service for maintenance, repairs, improvements or other technical reasons. We will try to give reasonable notice of planned maintenance and restore the Service as soon as reasonably practicable.
19. Restrictions on our legal responsibility – very important
THIS SECTION LIMITS OUR LEGAL RESPONSIBILITY IN VARIOUS WAYS AND MAKES YOU RESPONSIBLE FOR CERTAIN LOSSES WE SUFFER
19.1Nothing in these terms in any way limits or excludes our liability for negligence causing death or personal injury or for fraud or fraudulent misrepresentation or for anything which may not legally be excluded or limited. In this section, any reference to us includes our officers, employees and subcontractors, who have the right to enforce these terms.
19.2If you are a Consumer, subject to the first clause above (“Nothing in these terms…”):

- was not caused by our breach of these terms or legal duty;
- was not reasonably foreseeable;

- relates to your business activities; and
- you are responsible for reasonably foreseeable loss or damage we suffer as a result of your breach of these terms or misuse of our Service.

- To the fullest extent allowed by law, you and we exclude all terms, conditions, warranties and representations howsoever arising, whether imposed by statute or by law or otherwise, that are not expressly stated in this agreement.
- We will not be liable under or in connection with this agreement, whether in contract, tort (including negligence), misrepresentation, breach of statutory duty, or otherwise, for any:
- loss of profit; loss of data; loss of use; loss of production; loss of contract; loss of opportunity; loss of savings; or harm to reputation or loss of goodwill; or
- indirect, consequential or special losses.
- Our total liability for all other losses arising under or in connection with this agreement whether in contract, tort (including negligence), misrepresentation, breach of statutory duty, or otherwise, for any act or omission or series of connected acts or omissions will not exceed the total fees paid or payable by you to us in connection with our Service in the 12 months before the first act or omission complained of.
- You will indemnify us against all claims and liabilities arising out of or in connection with your use of the Service and/or breach of this agreement (except insofar as we are at fault).
- This agreement constitutes the entire agreement between us with respect to its subject matter and supersedes any previous communications or agreements between us. Neither of us has relied on any pre-contractual statements.

THIS SECTION CONFIRMS THAT YOU AND WE REMAIN OWNERS OF COPYRIGHT AND OTHER IP RIGHTS IN OUR RESPECTIVE CONTENT AND SETS OUT HOW WE ALLOW EACH OTHER TO USE THE CONTENT
IP in your Content
20.1You remain the owner of the IP in your Content. You allow us use such material insofar as reasonably necessary for our Service. You allow each User to use your Content in accordance with these terms and conditions. You give us the right to take any legal action we think necessary if there is an infringement of the intellectual property rights in your Content.

23. Transferring rights/obligations
IN SHORT: WE CAN PASS OUR RIGHTS/OBLIGATIONS TO SOMEONE ELSE BUT YOU NEED OUR PERMISSION TO DO LIKEWISE
23.1We may transfer our rights or obligations under these terms provided this does not materially reduce your rights. You may not transfer your rights or obligations without our prior written consent.
24. English law and courts
IN SHORT: ENGLISH LAW APPLIES AND ONLY UK COURTS CAN ADJUDICATE ON DISPUTES
24.1These terms and conditions are covered by the law of England and Wales. If you are a Consumer, you also benefit from any mandatory protections in any other country where you live.

This Annex applies only if you are a Consumer and only to contracts for services or digital content. Separate rules apply to physical goods.
1. Your 14-day cancellation right
1.1Where you have a legal right to cancel, you may cancel the contract without giving a reason within 14 days after the contract is made.
1.2This may apply to:
- your purchase of Seller Services from the Seller; and
- your purchase of Coins from us, subject to section 3 below.
1.3Some contracts do not have a 14-day cancellation right, including certain leisure services to be provided on a specific date or during a specific period (e.g., pre-scheduled or one-to-one live sessions).
2. Services started during the 14 days
2.1If you ask us or a Seller to start providing a service during the 14-day cancellation period and then cancel, you must pay an appropriate amount for the service supplied before cancellation.
2.2You lose the cancellation right once the service has been fully performed if you expressly requested early performance and acknowledged that you would then lose that right.
3. Digital content
3.1If you expressly agree to digital content being supplied during the 14-day cancellation period and acknowledge that you will lose your cancellation right when supply begins, you lose that right when supply begins.
3.2This applies, where relevant, to Coins credited immediately to your account and to digital Content supplied by a Seller.
4. How to cancel
4.1To exercise a cancellation right, you must tell the person you contracted with - either us or the relevant Seller - clearly that you wish to cancel before the 14-day period ends.
4.2You can use the cancellation methods explained on our Service or the model cancellation form below, but you do not have to use the form.
4.3Where we handle cancellation on behalf of a Seller, you can send the cancellation notice to us using the contact details shown on our Service.
4.4Any refund due following cancellation will be made without undue delay and no later than 14 days after the cancellation notice is received, subject to any permitted deduction for services already supplied.
